DB2 possible shipping damage: need opinions.

I think today's response may have hung him, but the gray area come into where I talked him down on it, and he re-listed.

"Dear robertborneman,shipping is insured and I can throw it in the purchase price anything else just ask thanks.- brian26kristi"

that was prior to the re-listing, but IMO if things changed about the included insurance, he should have mentioned it.

looking at it word for word, unfortunately he didnt ever agree to insure for the amount.

today's response kinda torques me, it was almost guaranteed to have been destroyed on high speed sorting equipment at little rock, considering it spent almost a week there according to the tracking number. Our local post office is the end of the line, and they are careful with stuff.

here is a pic of the packing. too small of box IMO, and hte corner where the fuel inlet and outlet fittings are was stuffed in the corner with packing on two sides, top and bottom, none in the actual corner itself. the box was tore open at that location.

 
Well only thing I can see is he said he would insure it. Do you need paper work from him? (I never had to do an insurance claim). If ebay requires he produce the paper work you may have a case (ask ebay).

Who files the claim from USPS the sender or reciever?
I would still file with your CC co.
 
When i filed the USPS claim, it asked for a transaction number, which appeared on the receipt, which he threw away.
the wording on the application basically eludes to that they need it no matter what, and the claim would be delayed if they had to get the number from him.

should I bother with paypal, or just go directly to Discover card?

I have the paperwork ready to mail monday to USPS, got a explanation letter, printoff from penisular, and a claim summary printoff. need to buy an ink cartridge, all printoffs are a little on the gray side, and are a little faint, hopefully that wont negatively affect things.
 
File with paypal Discover and ebay. I think he should be on the hook to atleast get you the trans #.
Seems like eveything you would need should be on the lable though, I mean if USPS is making you responsible for the trans # it should be on the lable right?. How do they know if you would be able to get that info from the sender? Seems like BS to me.
Can you get the Trans# from the tracking # details online?

Are you kidding me? UPS recommends 2" of packing around the item. He may as well just have taped a label to the pump and left the expense of the box off. Likely something poked through and hung the box up.

It is the seller's responsibility to properly package an item. They clearly failed to do so.
 
check showed up from USPS today. murphys law, I am on the nevada trip, will try to rush home, or see if dad can handle it when he gets back.

chck was for the max amount, 200 plus the shipping, so 215.40 way better than nothing, but still, I am short a few bucks.
 
so do you think I should close all the cases and leave him negative feedback, or go after the difference?

I will see if I can keep the pump. If I can, I may just try to find that gutted humvee pump on e-bay and hope its housing is good, and hire a shop to swap guts.

If USPS want the pump, what course of action would be the best to try to collect the difference? its 40 bucks roughly for the difference in what I paid versus what I got.
 
His poor packing cost you money, time, and aggravation. let the cases close by running their course.
 
X2, And neg feedback is warranted because he agreed to insure it. In my eyes and anyone with common sense would insure it for full value in order to make the customer whole if it was damaged. The guy is an idiot. As the seller he cannot leave you neg feedback.

me personally, on the end with the fittings, I would have found a round plastic bottle, cut the top off, put some paper in it, and put it over the end, trying to get it firm and snug with packing material.
 
so I will still need to talk to our post office gal to make sure its ok to deposit, see what else needs to be mailed off, etc. to close the USPS claim, but I am staring at the $215.40 check from USPS.

the total price was 255.

can I adjust my ebay claim to make up the difference, as in just go after the little extra to get my entire 255 bucks back? I would be happy to just get my 255 back. should I tell ebay or the seller that USPS paid?

maybe I should ask for 55, since he knows he only insured for 200.

anyhow, the point of my post here is to ask if the e-bay claim can be adjusted for a lower amount, the rest is just pondering ramblings late at night. :)

The response I listed in post 39 was the last contact from him.

the following is what I am debating about submitting. it fudges a little, but to protect my interests, I dont feel I should tell him a USPS check is in my possession....but maybe I should.
would telling him the full truth, the claim was paid by USPS, asking nicely, and then likely escalating the case to get the remainder of the 255 bucks be the better option?

also, should I remind him feedback has not been left yet?



I strongly disagree it was packaged adequately. there was no side padding on the inlet piece in the corner.

our post office was not the issue, the tracking showing it at the main arkansas terminal for over a week pretty well shows it was damaged, evaluated, and the box sealed and sent on from there.

the bigger the terminal, the higher speed equipment, and the rougher the handling. I still dont know how you havent had anything destroyed coming through little rock.

so here I am with a broken housing. The only solution that I can hope for the USPS claim coming through, and hopefully at least getting 200 bucks, but then I am out 55, plus wasted time.

would you be kind enough to chip in the 55 bucks?
I would need to find a parts pump for the housing and then hire a shop to swap the guts over, obviously costing way more than 55 bucks, so it would still be a money losing venture for me.

I would escilate with paypal. And , dont threat with feedback or ebay will slam you.
 
so I dont have a paypal claim open yet, just a e-bay claim. surely the e-bay claim will cover it, right? or should I fire up a paypal claim?

I will see his response, and if it a flat out F. you, then I will immediately escalate it.

If for some reason e-bay doesnt rule in my favor, I will fire up a paypal claim for sure.
