DB2 possible shipping damage: need opinions.

so paypal or e-bay first? or both at the same time?

how easy is it to cancel a USPS claim, and is it transferrable? If I can get e-bay to get me my money back, dont i need to change the payee from me to him on the USPS claim, or should I cancel it and tell him to file himself?
 
no response from him whatsoever, so I am opening a e-bay claim. I am stuck at a point where it asks what I want between two options. should I ask for a full refund, or select the box that says I want to keep the item?

Since I have an active claim with USPS, I should select keep it, correct?
 
Last time with ebay I elected to keep an item and seek some compensation I would up loosing the case, however every time that I have asked for a full refund for item return I have been successfull.

well crap, I selected "keep the item".

is it changeable?

I should probably give up any hope of keeping it and finding another housing, and just wash my hands of the whole problem.
 
possible good news folks, logged into the USPS online account so I could print off a summary. The reason is because they wanted proof of value or repair mailed in along with the claim summary, so I was going to ready that and mail it today. since there are no used or re-built DB2's on e-bay (for turbocharged 12V applications anyways, there is one crusty old 6.2L pump and a few humvee pumps), I was going to provide a printoff from Peninsular for their 1,200 dollar new DB2, so my 300 bucks I asked for on the claim looks like a bargain for them.

so, Im logged in, and the status says approved. does this mean its a viable claim that they are looking into, or did they actually make a decision that fast and I am going to get my money back?

how long before I cant get paypal involved? guy is quickly turning into an ass. EDIT just checked, 45 days, so I am good for a little. may see how e-bay progresses, may call USPS.

here is his response after ignoring me for a week, and after me opening the case. In the message to seller portion I mentioned I needed the transaction number for the USPS case, and what he actually insured it for.

"At this time I know longer have the insurance receipt it has been misplaced or thrown away because it took you 14 days to contact me on a 3-4 day package. I have contacted the USPS service and they told me that was very odd to have taken that long. Their response was you should have contacted me after 5 days and they would have looked into it. As far as the description, I contacted eBay Customer Support by phone, they told me I am not liable for damages during shipping as you have described in previous e-mail. They looked at the item description and said it was very clear no return or refund, as is, and no warranty. The USPS said I cannot file a claim without the receipt wish you would have contacted me sooner.."

Here is what I would like to respond with:
This all wouldnt have been an issue had the item been packed properly. I mentioned that stuff has been getting beat up lately, and to pack it very well. a few crumpled newspapers and a critical piece of the pump stuffed into a corner with no protection isnt what i call adequate packaging.

I also asked for proper insurance, which you keep dodging the question. did you, or did you not insure it for the amount or more to cover replacement? my postmaster says no more than 200 bucks judging by that label.
 
File with paypal now! Did you pay with a paypal balance or use a credit card? If paypal balance I have found they lean toward helping the buyer. If credit card file with them also.

I would not reply to him. File with Paypal, CC, Ebay. Has he left you feedback yet?


Edit: maybe you should reply to him, but only with facts (as you have)(don't get personal or threaten Neg feedback) maybe he will hang himself? if you get him to talking.

good idea, I dont think my post above is too mean, so I think it would be interesting to see what he says. he allready had the F U attitude when I first got it (sorry to hear, but once USPS had it its their responsibility, kind of a "too bad so sad, not my problem" type of respnse IMO.) then he got more standoffish when I kept asking for the transaction number, and most importantly, the insured amount. there were two ignored messages prior to me opening the claim, so he is obviously beating around the bush.

and then considering most claims are 30, 45 or 90 days window, the part about this being so long after the purchase and how I took way too long to complain, etc. also ruffled my feathers.

Considering the time limit for complaints via e-bay is like 45 days, I dont call 15 days a long time, and discarding paperwork on an item of this value is un-professional. if the insurance claim doesnt cover the full amount, will you be willing to cover the remainder? the only non-factual statement was the one about the 45 days. I beleive that to be correct, but I did not look it up.

when I looked at paypal, all it seemed to want to do was direct me to the e-bay resolution center. is there a way around this?

also, does anyone have experience with purchase protection with discover card, or any credit cards for that matter? will they give you your money back and then go after it themselves, or just cut their losses and make their money back on interest?

As far as USPS, I put in an e-mail, asking a few questions, and I printed off a letter explaining the situation, the value, the replacement costs, etc. I used a page printed off from peninsular's website to show what a new one costs (1,249 bucks) to make my requested 300 bucks look good. I will get the letter in the mail on monday, unless USPS says otherwise.

I still dont know how I can request 300 bucks if the insurance may only be good for 200.
 
I believe the resolution center is how you start the process. gives the seller a chance to respond to your claim

"This item was properly packed when shipped, I have received two similar items packed the same way without a problem! The package was insured for $200, I never said I would over insure it and it wasn't included in the listing when purchased. I know that eBay gives you an estimated delivery date and the tracking number does as well. You did not contact me to let me know that the item was not received so I discarded the receipt. I HAVE NEVER HAD A PROBLEM WITH SHIPPING AN ITEM. EBAY DOES NOT REQUIRE A SELLER TO INSURE A PACKAGE. If you have had problems with packages getting "beat up" maybe you should contact your post office about that. In the item description it specifically says no refund, returns, or exchanges. Considering this was a shipping problem, I am not at fault. I will not be refunding any money, I lowered the price to begin with. Like I mentioned before, if you knew this was going to get damaged before I even shipped it then you should have spoken to your post office."
