Lemon Laws on ATV's

Anyone know if there are any lemon laws on ATV's? I've got this 07 Arctic Cat 650 an it's a great running ATV when I have it but it has been living in the shop and I'm fed up with it :cuss:. The dealer has been good at getting most stuff covered under warranty but we're talking 110-120 days of downtime in the 16months I've owned it and easily $4000 in warranty work :cuss:. My Honda Foreman 450 with 30,000+ miles has cost me less than $1500 in repairs {except for one wreck I had that insurance covered} and my Dads Honda Foreman 450 has only cost him less than $500 in 21,000 miles. Downtime on them is minimal as well. Dealer always has parts and there is no waiting.

Problem B is the Honda dealers won't touch it. They have told me outright that they won't trade for an Arctic Cat.
 
Your state probably does not have a lemon law for ATVs, but you do have a warranty claim against the manufacturer and the dealer (as the manufacturer's representative). You purchased their product, which carries with it an implied warranty that it will perform as advertised.

You might need a lawyer if the dealer won't make things right.

What can I do on a dealer level? The dealer is also our New Holland dealer and we get some parts there so I don't want to piss them off but I feel the company, at minimum should trade me into a new one for minimal costs. I don't want another Arctic Cat but maybe I could trade a new one off since so far I can't find any dealers that want this one :mad:

Start making phone calls to mfg. Just be nice and patient to the people you talk to and make your way up the chain...
 
They don't answer :mad:,even the dealer has had issues getting contact with them :mad:.

I'd lean on the dealer. Sit down with the senior decision maker at the dealership, bring your documentation, and present your case. Be fair in what you ask for, and be willing to compromise where reasonable. A fair outcome may be for the dealer to take the ATV back (refunding your purchase price), and charge you 50 cents per mile for the time that you did use it. They can then decide whether they want to fix it on their dime and re-sell it, or go back against the manufacturer themselves.

Be ready to roll up your sleeves and fight it in court, though. Small claims is less expensive than hiring an attorney, and might be worth considering depending on the statutory limits there. You can also go public and call a local consumer hotline television station (or threaten the dealer with that option).
 
I have 5,000mi on it. That would be a $2500 loss which I don't really want. i'm prepared to take a $1500-$2000 trading it but beyond that I don't want to. It books at $4800-$5200 and I paid $6800.
 
Good Luck... Not being a dick at all but it is an Arctic Cat. I help out at a 10k+ head feedlot and we have had every quad made there and Polaris is the only thing to hold up the "best" although they all had thier ass kicked. My local NH/Kubota dealer quit dealing Cat's due to all the problems.
 
Evidently you didn't have an 98-04 Foreman cause they will take whatever you can dish out ):h. The Polaris my uncle had was just as bad as this Arctic Cat,but he traded it off immediately after it started giving him issues.

word to that!! 98 foreman here and its just like a good woman, the harder you ride her the more she likes it! shaft drive and solid rear axle is the only way to roll!

so 6spd, not to salt the wound but if you guys have had such good luck with your hondas, why did you go with the cat in the first place?
 
Cause the freaking Honda dealer is 80 miles away one way and 120 miles the other. Not that they need service but it's nice to have filters and wheel bearings handy.
The Arctic Cat dealer is 35mi away but at this point it's not worth jack $h!t to have them close.

I believe you are looking at it all wrong. It SHOULD be the dealer that does not want to piss YOU off. You are the customer, you can use another dealer.
 
Well I was in there today and they said they were going to try to get me a 750 V2 Diesel so we'll see. I hope they can pull that off for me but time will tell.
 
Well guys it's been 6mo and I'm getting really pissed. So far the dealer has been all talk. Right now the holes where the A-Arms attach are all egged out which has cause it to nearly throw me off twice and the trans/clutchesare out again :mad2::mad2:. Freaking thing just wraps way up before it moves and the the belt will smoke. Less than 1000mi on new trans/clutches and belt.
I've been trying to not even ride it but I left my Foreman at the shop so I grabbed this thing to go look for some deer and what do ya know,it barely got me back to the house :mad2:.

BTW I think it's close to $5300 in warranty repairs now. I really want a new Honda.

We have a pair of fourtrax 300's that have gone at least that far and are still going! Just replaced some front end parts on the one, but nothing but oil changes and simple maintenance on them otherwise!
